Clarificări suplimentare referitoare la aplicarea taxei pentru poluarea mediului

Ministerul Mediului a oferit câteva clarificări suplimentare referitoare la aplicarea taxei pentru poluarea mediului și regimul Responsabilității Extinse a Producătorului (REP), pe care le prezentăm în continuare sub formă de întrebări-răspunsuri. Aceste clarificări vin în sprijinul agenților economici pentru o aplicare corectă a prevederilor fiscale și a principiului responsabilității extinse a producătorului, contribuind la asigurarea conformității cu legislația în vigoare.

 

 

Există obligația de a achita taxa pentru poluarea mediului pentru containerele de uz intern pentru mere?

Containerele importate pentru uz intern în agricultură (poziția tarifară 44151010) nu sunt considerate ambalaje de desfacere și nici nu conțin produs în momentul importului. Prin urmare, pentru acestea se aplică doar prevederile anexei nr. 8 din Legea nr. 1540/1998 privind plata pentru poluarea mediului. Totuși, dacă respectivele containere sunt importate într-un alt ambalaj, pentru acel ambalaj se vor aplica obligațiile specifice privind ambalajele.

 

 

 Importatorii de vehicule N1 trebuie să facă parte din REP?

Da. Importatorii de vehicule din categoria N1 trebuie să facă parte din sistemul de responsabilitate extinsă a producătorului (REP) pentru vehiculele scoase din uz, conform Regulamentului privind gestionarea vehiculelor scoase din uz aprobat prin HG
nr. 93/2023. Aceste clarificări vin în sprijinul agenților economici pentru o aplicare corectă a prevederilor fiscale și a principiului responsabilității extinse a producătorului, contribuind la asigurarea conformității cu legislația în vigoare.
