Agenția Achiziții Publice va deveni agent constatator

Încălcarea regulilor de iniţiere şi desfăşurare a procedurilor de achiziţii publice va fi constatată de către Agenția Achiziții Publice. Inițiativa legislativă în acest sens este înregistrată în Parlament și are ca scop asigurarea procedurilor transparente de desfășurare a achizițiilor publice.
 
Astfel, se propune completarea art. 402 din Codul contravențional, ce reglementează contravențiile stabilite de autorităţile administrative din subordinea Ministerului Finanţelor, cu prevederea potrivit căreia Agenția Achiziții Publice devine agent constatator pentru contravențiile stabilite la art. 3271 din Cod (încălcarea regulilor de iniţiere şi desfăşurare a procedurilor de achiziţii publice).

 

Potrivit notei informative a proiectului, actualmente nu există o instituție abilitată cu funcția de organ constatator al încălcărilor menționate, deși în Codul contravențional există un articol (3271) care prevede aplicarea sancțiunilor pentru nerespectarea regulilor privind desfășurarea achizițiilor publice, fără a fi stabilit și organul care constată aceste încălcări.

 

Această lacună legislativă se atestă ca urmare a modificării în anul 2018 a Codului contravențional, prin care autorităților administrative de inspectare financiară din cadrul Ministerului Finanțelor li s-a retras calitatea de agent constatator în cazul încălcării regulilor privind desfășurarea procedurilor de achiziții publice.

 

Potrivit datelor Ministerului Finanțelor, în anul 2018 au fost întocmite 89 de procese-verbale pentru astfel de încălcări, iar după intrarea în vigoare a modificărilor, numărul acestora s-a diminuat, în anul 2019 fiind întocmite 8 procese-verbale, în anul 2020 – 0, iar în anul 2021 – 2 procese-verbale. Mai mult decât atât, cele 10 procese-verbale din perioada 2019-2021 au fost emise contrar legii, dat fiind faptul că autoritățile emitente nu dețineau statutul de agent constatator.
