Банки предоставят ГНС информацию о счетах, открытых нерезидентами

Физические лица-нерезиденты (иностранные граждане или лица без гражданства) и юридические лица-нерезиденты, не имеющие налоговых обязательств и/или не располагающие объектами налогообложения на территории Молдовы, могут открывать банковские счета в финансовых учреждениях (отделениях или их филиалах) нашей страны. Однако теперь финансовые учреждения обязаны предоставлять в ГНС информацию об открытых счетах этими лицами, а также о последующих операциях с ними, в том числе закрытии счетов. Это предусматривают изменения в Инструкции по учету налогоплательщиков (Приказ Государственной налоговой службы № 352 от 28 сентября 2017 г.), которые были опубликованы 11 мая в «Monitorul Oficial» и вступили в силу. Согласно документу, открытие счетов нерезидентами, которые не имеют налоговых обязательств и не располагают объектами налогообложения в Молдове, осуществляется на основании документов, удостоверяющих их личность, или документа, признанного в качестве свидетельства о присвоении фискального кода/решения о регистрации в стране происхождения. Для этой категории лиц фискальным кодом является серия, номер и код, указанные в сертификате об открытии банковских счетов нерезидентов, выданном финансовым учреждением на основании ранее указанных документов, присвоенный ГНС. Соответственно, в Инструкции появилось и новое приложение – № 81 – бланк Сертификата об открытии банковских счетов нерезидентами (физическими и юридическими лицами, которые не имеют налоговых обязательств, не владеют недвижимым имуществом). В нем заполняется номер, тип и валюта открываемого счета, указывается финансовое учреждение, в котором открывается счет, персональные данные лица-нерезидента. Документ подписывается главным бухгалтером финансового учреждения. Изменение или закрытие счетов нерезидентов, не имеющих налоговых обязательств и/или объектов налогообложения на территории Молдовы, осуществляется в соответствии с приложением №11 к Инструкции. Предусмотрено, что финансовое учреждение (его отделение или филиал) обязано сообщить Государственной налоговой службе об открытии/изменении/закрытии банковских счетов указанных лиц через автоматизированную информационную систему электронного документооборота между ГНС и финансовыми учреждениями (заполняя приложения № 81 и № 11).
