Codul Muncii a fost completat cu un nou articol – ”Concediu paternal”

În Monitorul Oficial nr. 140-149 din 27.05.2016 a fost publicată Legea nr. 71 din 14 aprilie 2016 pentru modificarea și completarea unor acte legislative. Astfel, legiuitorul a completat Codul Muncii nr. 154-XV din 28 martie 2003 cu un articol nou – 124¹ ”Concediu paternal”, care prevede că concediul paternal se acordă pe un termen de 14 zile pentru a asigura participarea efectivă a tatălui la îngrijirea copilului nou-născut. Concediul paternal se va acorda în primele 56 de zile de la nașterea copilului, în baza unei cereri scrise a salariatului, cu anexarea certificatului de naștere a copilului. De asemenea, legiuitorul a prevăzut că, pe perioada concediului paternal, salariatul va beneficia de o indemnizație paternală care nu va fi mai mică decît mărimea salariului mediu cuvenit pe perioada respectivă și care va fi achitată din fondul de asigurări sociale. Totodată, cazurile în care angajatorul va crea situații cu efect de dezavantajare a angajaților care iau concediu paternal se vor considera cazuri de discriminare și vor fi pedepsite conform legii. Prezenta lege intră în vigoare la data publicării în Monitorul Oficial.
