Conceptul soluției fiscale individuale anticipate va fi examinat în contextul elaborării politicii fiscale și vamale pe anul viitor

Guvernul salută implementarea în legislația națională a conceptului ”soluției fiscale individuale anticipate”. Inițiativa legislativă privind introducerea acestei practici europene și internaționale și în Codul fiscal al RM aparține deputatului Andrian Candu. Soluția fiscală individuală anticipată constituie un instrument, care este aplicat pentru cazurile de interpretări diferite ale legislaţiei de către organele fiscale și mediul de afaceri. Deseori, agentul economic tratează într-un fel cheltuielile deductibile sau plata impozitelor și taxelor, iar Fiscul în altul. Adresîndu-se la Serviciul fiscal, agentul economic primește o scrisoare în care i se explică, cum să procedeze. Dar dacă peste un an sau doi, organul fiscal decide că impozitele și taxele nu au fost calculate corect, contribuabilul este obligat să plătească impozitul recalculat. Cazuri de acestea sunt foarte multe. În nota informativă care însoțește proiectul modificărilor și completărilor la Codul fiscal, este amintit cazul companiei germane Draexlmaier, care a solicitat organului fiscal Bălţi o interpretare referitor la tratarea ajutoarelor materiale. După doi-trei ani IFPS a calificat, că la calcularea impozitelor și taxelor au fost comise erori. Au fost calculate penalități și amenzi pentru neplata la termen, încasate forţat anumite sume de bani. Pentru a evita asemenea situații, vine în ajutor soluția fiscală individuală anticipată. Acesta presupune, că atunci cînd agentul economic va solicita Fiscului consultări, cum trebuie să procedeze într-un caz sau altul, documentul eliberat nu va mai fi, pur şi simplu, o scrisoare, ci un document oficial cu putere de lege în relaţiile dintre agentul economic şi autoritatea fiscală. Guvernul consideră că inițiativa legislativă a deputatului va permite evitarea multor situații de conflict, precum și economisirea banilor pentru cheltuielile de judecată, reorientarea acestora în dezvoltarea producției. Totuși, executivul consideră oportun ca acest concept al soluției fiscale individuale anticipate să fie examinat în procesul elaborării și promovării politicii fiscale și vamale pe anul viitor 2017. Astfel conceptul va parcurge întreg procesul de consultări prevăzute de legislație și vom avea în final un proiect de lege, agreat atît de mediul de afaceri, cît și de autoritățile fiscale, a precizat ministrul finanțelor Octavian Armașu. Armașu a mai adăugat în context, că procedura de modificare și perfecționare a unor acte legislative în vigoare, din care va rezulta politica bugetară, fiscală și vamală pe anul 2017 a demarat la 8 aprilie 2016.
