Înregistrarea și comunicarea accidentelor de muncă

Accidentele de muncă se înregistrează în Registrul de evidență a accidentelor de muncă/bolilor, cu indicarea datei și orei producerii accidentelor, numelui și prenumelui salariatului, specialității, locului unde s-a produs accidentul, numărului de înregistrare și datei întocmirii proceselor-verbale privind cercetarea accidentelor, cauzele și circumstanțele accidentului, precum și categoria acestuia – grav, mortal, individual, colectiv. În Monitorul Oficial din 14 iunie curent a fost publicată Hotărârea Guvernului nr. 291 din 11 iunie 2019 cu privire la aprobarea modificărilor ce se operează în unele hotărâri ale Guvernului. Potrivit hotărârii, angajatorul, în funcție de domeniul de activitate, va comunica imediat despre producerea accidentelor de muncă autorității competente în domeniul siguranței ocupaționale respective, Casei Naționale de Asigurări Sociale și, după caz, organului ierarhic superior, organului sindical de ramură și Agenției Naționale pentru Sănătate Publică. Totodată, în toate cazurile în care autoritatea competentă în domeniul siguranței ocupaționale a aflat despre producerea unui accident, aceasta este obligată să se autosesizeze. De asemenea, ea asigură crearea și gestionarea unui sistem de recepție și înregistrare a comunicărilor despre accidentele produse și informează Inspectoratul de Stat al Muncii, în termen de 5 zile. Accidentele grave și mortale produse la locul de muncă se cercetează de inspectorii autorității competente, iar cele cu incapacitate temporară – de comisia angajatorului. Dacă angajatorul nu are posibilitatea de a constitui o comisie, inspectorii autorității competente se vor ocupa și de aceste cazuri. La cercetarea accidentelor au dreptul să participe, după caz, reprezentanții împuterniciți ai organului ierarhic superior, ai autorității administrației publice locale, ai CNAS, organului sindical, specialiști din domeniul de activitate al angajatorului. Totodată, au dreptul să asiste persoanele care reprezintă în mod legal interesele accidentaților sau ale familiilor acestora. Dacă autoritatea competență va constata că, la cercetarea accidentului, au fost comise erori sau au apărut noi circumstanțe ale producerii acestuia, conducătorul autorității dispune o cercetare nouă sau suplimentară. De asemenea, autoritățile competente în domeniul siguranței ocupaționale prezintă anual, trimestrial, precum și la solicitare, Inspectoratului de Stat al Muncii, datele privind accidentele de muncă înregistrate. Prevederile au intrat în vigoare la 15 iunie 2019.
