Инструкция по учету налогоплательщиков претерпела изменения

Государственная налоговая служба внесла изменения в Инструкцию по учету налогоплательщиков, утвержденную Приказом №352  от 28 сентября 2017 г.
В документе установлены правила постановки на налоговый учет нерезидентов, которые осуществляют предпринимательскую деятельность без организационно-правовой формы в Молдове и предоставляют услуги через электронные сети физическим лицам-резидентам республики, не осуществляющим предпринимательскую деятельность.

 

Предусмотрено, что фискальным кодом для этой категории налогоплательщиков признается идентификационный номер, указанный в документе, подтверждающем госрегистрацию в стране происхождения, с их идентификацией в качестве субъекта налогообложения с НДС в Молдове в ИС ГНС.

 

Эта категория налогоплательщиков должна подать заявление о постановке нерезидента на налоговый учет (согласно приложению №21 к Инструкции) на официальной странице ГНС, в разделе «e-Commerce VAT». К заявлению прилагается копия документа, выданного в стране происхождения, подтверждающего регистрацию и правовой статус нерезидента, в формате отсканированного изображения.

 

Постановка нерезидента на налоговый учет подтверждается справкой (приложение №22 к Инструкции), и обновлением соответствующих данных в Государственном налоговом реестре в подсистеме «e-Commerce VAT».

 

Также уточняется п.46 Инструкции, согласно которому основанием для выписывания свидетельства о взятии на учет банковского счета является изданный и переданный НБМ,  банком (его отделением)  электронный документ, подтверждающий открытие банковского счета. Согласно инструкции, поставщики платежных услуг информируют ГНС посредством АИС создания и оборота электронных документов между ГНС и финансовыми учреждениями о закрытии банковского счета (приложение №111 к Инструкции) или об его изменении (приложение №11, изменения, внесенные в числовой код валюты, в которой был открыт счет, и/или в План счетов бухгалтерского учета в банках, имеющих лицензию в Молдове, или изменение кода банка, в котором открыт банковский счет).

 

Приложение №11 к Инструкции было скорректировано (теперь это Сертификат об изменении банковского счета). Кроме того, инструкция дополнена тремя новыми приложениями:

  • Приложение №111(Сертификат о закрытии платежного/банковского счета).
  • Приложение №21(Заявление о постановке на налоговый учет нерезидента, осуществляющего предпринимательскую деятельность без организационно-правовой формы в Молдове).
  • Приложение №22(Справка о постановке нерезидента на налоговый учет).

Перечисленные изменения в Приказ  №352 от 28 сентября 2017 г. опубликованы в «Monitorul Oficial» и вступили в силу 19 июня 2020 г.
