Льготы на импорт сахара из свеклы будут исключены из схем госпомощи

Пленум Совета по конкуренции рассмотрел отчет по мониторингу существующих схем государственной помощи, которые предусматривают применение уменьшенной таможенной пошлины на импорт сахара и изделий из сахара, в том числе до предела тарифных квот, предоставленных странам - членам Евросоюза и странам, с которыми Молдова не имеет соглашений о свободной торговле, а также применение пониженной ставки НДС на импорт сахара из сахарной свеклы и определил, что они не подпадают под действие Закона о государственной помощи. Совет по конкуренции распорядился, чтобы Министерство финанасов и Таможенная служба исключили указанные меры поддержки из перечня схем государственной помощи, которые ежегодно предоставляются Совету по конкуренции. В частности, изучив все материалы, Совет по конкуренции констатировал, что мера поддержки для применения сниженной таможенной пошлины на импорт сахара и сахарных продуктов в пределах тарифных квот (по ставке 10% - в пределах установленной квоты и 75% - остальная часть импорта), предоставленная на основании пояснений в главе 17 к Комбинированной товарной номенклатуре, прилагаемой к Закону № 172 от 25 июля 2014 г. об утверждении Комбинированной товарной номенклатуры, и Постановления Правительства № 114 от 22 февраля 2012 г. о порядке администрирования тарифных квот на импорт белого сахара и изделий из сахара, не подпадает под действие Закона № 139 от 15 июня 2012 г. о государственной помощи. Такое же решение СК принял и в отношении меры поддержки в виде применения пониженной ставки НДС (8%) на импорт сахара из сахарной свеклы, предоставленной на основании ст. 96 лит.b) Налогового кодекса. По данным Таможенной службы, в 2011 г. объем государственной помощи, предоставленной на импорт сахара из сахарной свеклы, составил в целом 51,3 млн леев, в 2012 г. – 57,8 млн леев, в 2013 г. – 32,2 млн леев.
