Noi prevederi propuse pentru Instrucțiunea privind evidența obligațiilor față de buget

În termen de până la următoarea dată de închidere a perioadei de raportare, pentru clasificațiile economice1 111121, 111130, 113161, 113171, 113220, 113240, 113611, 114426, 142216 se va asigura identificarea și compensarea supraplății în contul stingerii restanței, pentru cazurile când în contul curent generalizat al contribuabilului se înregistrează:

 

a) sold pe Debit la plata de bază și sold pe Credit la majorare de întârziere;
b) sold pe Credit la plata de bază și sold pe Debit la majorare de întârziere.
 

Prevederea este inclusă în proiectul  propus de către Serviciul Fiscal de Stat pentru consultări publice. Documentul vine cu completări la Instrucțiunea privind evidenţa obligaţiilor faţă de buget (Instrucțiune) aprobată prin Ordinul IFPS nr.400 din 14 martie 2014.

 

În cazul aprobării proiectului în redacția propusă, compensarea periodică automatizată se va efectua pentru persoanele fizice (cetățeni), iar tranzacția va fi generată în cazul în care contribuabilul va înregistra sold Debitor și Creditor, conform condițiilor expuse supra, în cadrul unei clasificații economice și localități.

 

Totodată se propune completarea Instrucțiunii cu cap. X2 „Generarea Rapoartelor CC01TR și CC02OR”, care prevede că respectivele rapoarte sunt destinate pentru utilizare de către subdiviziunile SFS și oferă posibilitatea recalculării majorărilor de întârziere (în pofida închiderii perioadei de raportare reglementate la cap. IV din Instrucțiune), pentru cazurile în care intervine necesitatea restabilirii sumelor obligațiilor fiscale de la evidența specială, cu stingerea repetată prin scădere și luarea acestora la evidența specială.

 

Raportul CC01TR, după cum prevede proiectul, va conține compartimentele reglementate la pct.51 din Instrucțiune și vor fi aplicabile posibilitățile de selectare, generare și afișare expuse la pct. 53-55 din Instrucțiune. Raportul CC02OR va conține compartimentele reglementate la pct.63 din Instrucțiune și vor fi aplicabile posibilitățile de selectare, generare și afișare expuse la punctele 64-66 din Instrucțiune.
