Об обязательстве работодателей-нерезидентов по социальному и медицинскому страхованию граждан РМ

Мы являемся гражданами Республики Молдова и работаем на предприятии, которое является нерезидентом. Обязан ли указанный нерезидент обеспечить наше обязательное государственное социальное и медицинское страхование? В соответствии с положениями лит. b) ч.(1) ст.17 Закона о государственной системе социального страхования № 489-XIV от 08.07.1999 г., в качестве плательщиков взносов социального страхования установлены работодатели, независимо от того являются ли они резидентами или нерезидентами Республики Молдова. В то же время, в качестве плательщиков взносов ОГСС установлены и лица, работающие по ИТД у работодателей, которые не зарегистрированы в качестве резидентов РМ. В то же время, согласно положениям и ч. (1) ст.20 указанного закона, исчисление размера и уплата взносов социального страхования, которые должны поступать от застрахованных лиц, работающих по ИТД, и их работодателей, ежемесячно производятся работодателями. Соответственно, нерезидент, являющийся работодателем, обязан исчислять указанные взносы и таким образом обеспечивать ОГСС работающих у него по ИТД граждан РМ. ОМС указанных граждан регламентируется положениями ст. 2 Закона о размере, порядке и сроках уплаты взносов обязательного медицинского страхования № 1593-XV от 26.12.2002 г. и ч. (3) ст. 4 Закона об обязательном медицинском страховании № 1585-XIII от 27.02.1998 г. Согласно положениям ст. 2 Закона № 1593, действие данного закона распространяется и на иностранцев, указанных в п. о) ч. (4) ст. 4 и в ст. 9 Закона № 1585. А в соответствии с положениями ч. (3) ст. 4, страхователем для работающих лиц (работников) является работодатель, причем исключений для работодателей – нерезидентов законом не предусмотрено. Таким образом, любой работодатель граждан РМ обязан обеспечить их обязательное медицинское страхование, независимо от того, является ли он резидентом или нет.
