Obiectele de proprietate intelectuală vor fi remunerate în baza contractelor

Ministerul Economiei și Infrastructurii și AGEPI au elaborat și propun pentru consultări publice modificări în Regulamentul privind obiectele de proprietate intelectuală create în cadrul exercitării atribuțiilor de serviciu. Amintim că acesta a fost aprobat prin Hotărârea Guvernului nr.1609 în că în anul 2003 și prevede că obiectele de proprietate intelectuală (OPI) create în cadrul exercitării atribuţiilor de serviciu urmează a fi remunerate, iar cuantumul remuneraţiei va constitui cel puţin 15% din profitul realizat sau prezumat, fiind calculat şi plătit autorului (coautorilor) nu mai târziu de sfârşitul fiecărui an de utilizare. Autorii proiectului consideră că această prevedere reprezintă o povară enormă și un factor care descurajează investițiile, în special în cazul elaborării produselor IT proprii. Respectiv, normele actului indicat pun în sarcina angajatorului mai multe cheltuieli: salariul lunar achitat salariatului – autor al operei de serviciu, care în cazul programatorilor este întotdeauna destul de competitiv; condiții de muncă corespunzătoare, fapt ce generează cheltuieli lunare (chiria oficiilor, încălzire, energie, apă, internet, publicitate etc.); cel puțin 15% din venitul brut al întreprinderii, adus de opera de serviciu creată de salariat. În rezultatul consultării practicii similare aplicate în regiune s-a constatat, că în Ucraina în astfel de raporturi juridice se reglementează prin acordul încheiat de părți. În România dreptul de autor (atât cel patrimonial cât și nepatrimonial) asupra operei de serviciu aparține salariatului – autor, însă angajatorul poate utiliza opera după bunul său plac și fără careva plăți suplimentare. Mai mult, dacă salariatul încasează venit din opera de serviciu creată, se obligă să compenseze angajatorului cheltuielile suportate pentru creare. Astfel, este propusă modificarea cadrului normativ național, prin proiectul vizat fiind propusă stabilirea prevederii că cuantumul remunerării, termenul şi modul de plată la crearea de către un angajat al unui OPI se negociază şi se stabilesc în contractul încheiat între angajator şi autorul produsului respectiv. În rezultat se așteaptă evitarea situaţiilor de conflict între angajat și angajator, creșterea competitivității produselor autohtone prin excluderea sarcinii de achitare a cuantumului în mărime de 15% din beneficiu în cazul cesiunii dreptului de autor asupra programului pentru calculator sau altei opere de serviciu către un terț, inclusiv din străinătate, și sporirea investițiilor. Proiectul poate fi consultat până la 10 aprilie curent.
