Оплата труда поденщиков не будет облагаться взносами ОГСС и ОМС

Законопроект, регламентирующий условия найма поденных сезонных работников, принят Парламентом в первом чтении. Представляя проект, государственный секретарь Министерства здравоохранения, труда и социальной защиты Анастасия Очеретный сказала, что законопроект направлен на борьбу с незаконным трудоустройством в основном в сельском хозяйстве, где этот вид найма наиболее распространен. «Проект регламентирует права и обязанности работодателя в соответствии с Трудовым кодексом, а также отрасли, в которых могут быть заняты сезонные работники, длительность работы и оплату их труда», - пояснила госсекретарь. Согласно проекту, работник должен получать зарплату в конце каждого рабочего дня, а ее размер не может быть ниже минимальной средней зарплаты по экономике. Из доходов работника не будут взимать взносы на социальное и медицинское страхование, а оплата подоходного налога ляжет на плечи бенефициара. Работодатель будет вести журнал сезонных работников, а также должен отправлять копию учетных записей в территориальное отделение Государственной инспекции труда. Некоторые депутаты считают, что закон может привести к нежелательным последствиям для тех, кто работает в области сельского хозяйства на основе стандартного контракта, поскольку работодателю станет выгоднее нанять на их место сезонных работников, чтобы избежать выплаты социального и медицинского страхования за работника, а закон не обеспечивает сезонным работникам социальную защиту. Также было высказано мнение о необходимости мотивировать нанимателя и работника заключать соглашения, предлагать им более привлекательные условия налогообложения и выплат социального и медицинского страхования.
