Reducerea venitului impozabil la crearea locurilor de muncă nu reprezintă ajutor de stat

Consiliul Concurenței a făcut publică Decizia Plenului consiliului nr. ASER-13 din 7 martie 2019, prin care constată că măsura de sprijin acordată sub formă de reducere a venitului impozabil cu o sumă calculată prin înmulţirea salariului mediu lunar pe ţară din anul precedent anului fiscal de gestiune la creşterea numărului mediu al salariaţilor în anul fiscal de gestiune faţă de anul precedent, dar nu mai mare de venitul impozabil prevăzută la art. 24 alin. (16) din Legea nr. 1164 din 24.04.1997 pentru punerea în aplicare a titlurilor I şi II ale Codului Fiscal al Republicii Moldova, nu constituie ajutor de stat în sensul art. 3 al Legii nr. 139 din 15.06.2012 cu privire la ajutorul de stat și urmează a fi exclusă din lista schemelor de ajutor de stat existente, care se prezintă anual Consiliului Concurenței de către Serviciul Fiscal de Stat. Decizia este bazată pe faptul că de această măsură de sprijin beneficiază întreprinderile din toate ramurile economiei naționale, indiferent de genul de activitate, nu este selectivă și poartă un caracter generalizator. Conform informației prezentate de către Serviciul Fiscal de Stat, în perioada anilor 2015-2017, de facilitatea fiscală indicată au beneficiat 215 întreprinderi, iar valoarea măsurii de sprijin raportată a constituit, în anul 2015, puțin peste 2 mil. lei, în anul 2016 – 6,47 mil. lei, iar un an mai târziu – 8,36 mil. lei. Deoarece Consiliul Concurenței are obligația de a monitoriza ajutoarele de stat existente în derulare pentru a verifica respectarea prevederilor actelor juridice în baza cărora acestea au fost acordate, autoritatea a ajuns la concluzia că, odată cu excluderea sintagmei “producţia activităţilor de bază ale cărora se determină conform anexei nr.7” din Legea nr. 1164 pentru punerea în aplicare a titlurilor I şi II ale Codului Fiscal, dar și ținând cont de prevederile Acordului de asociere RM-UE, Ministerul Finanțelor și Serviciul Fiscal de Stat urmează să excludă măsura de sprijin indicate din lista schemelor de ajutor de stat existente care se prezintă anual Consiliului Concurenței.
