Retragerea licenţelor va avea loc doar în baza hotărârii instanţei de judecată

Codul de procedură civilă (CPC) va fi completat cu un nou capitol ce ţine de suspendarea şi retragerea licenţelor/autorizaţiilor de întreprinzător. Astfel, va fi reglementată procedura de retragere sau suspendare a acestor acte, iar licenţele şi autorizaţiile vor fi retrase prin hotărâre judecătorească. La fel, recuperarea acestora se va face tot printr-o decizie a instanţelor. Prevederile sunt incluse în proiectul de modificare a CPC. Potrivit documentului, autorităţile administraţiei publice şi instituţiile abilitate cu funcţii de reglementare şi de control vor putea cere suspendarea sau, după caz, retragerea licenţelor/autorizaţiilor ce vizează activitatea de întreprinzător. În urma acestor acţiun, agentul economic nu-şi va putea continua activitatea. În cazurile în care sistarea temporară a valabilităţii sau retragerea licenţei/autorizaţiei va fi dispusă de autorităţi, aceasta va fi obligată, în decurs de trei zile lucrătoare, să se adreseze cu o cerere în instanţa de judecată privind suspendarea sau retragerea licenţei/autorizaţiei. În cererea de adresare în instanţă se vor indica probele ce atestă încălcarea din partea agentului economic, termenul acordat pentru remediere, modul de remediere a încălcărilor depistate, dar şi faptul că întreprinzătorul nu a înlăturat problemele depistate în termenul stabilit de autorităţi. Cererea va fi examinată în instanţă cu participarea agentului economic şi autorităţilor, dar şi a altor persoane interesate. Instanţa de judecată va trebui să examineze cererea de suspendarea sau retragere a licenţei sau autorizaţiei în termen de cinci zile de la data depunerii acesteia. În cazul în care agentul economic va remedia problemele, care au dus la suspendarea sau retragerea licenţei, instanţa de judecată, la cererea întreprinzătorului sau a autorităţilor, va intenta un proces şi în termen de cinci zile va pronunţa o decizie prin care va anula suspedarea actului.
