Sancțiuni mai mici pentru erorile statistice

Neprezentarea în termen a datelor statistice sau comunicarea de date statistice eronate va fi sancționată cu o amendă mai mică. Guvernul a aprobat proiectul de lege pentru modificarea Codului contravențional (CC). Conform relatării ministrului Finanțelor, Ion Chicu, proiectul are drept scop micșorarea sancțiunii prevăzute la art 330 din CC, care stabilește răspunderea pentru neexecutarea sau executare necorespunzătoare a obligațiilor prevăzute de lege privind prezentarea datelor statistice. Considerăm că sancțiunile stabilite sunt prea aspre în raport cu fapta săvârșită. Acest proiect continuă seria de inițiative pro-business lansate de Guvern și vine în susținerea mediului de afaceri, a mai declarat ministrul. Astfel, această încălcare va fi sancţionată cu amendă de la 12 la 42 de unităţi convenţionale aplicată persoanei fizice ( 600 la 2100 lei). În prezent această amendă constituie de la 50 la 80 UC sau 2500–4000 lei. Totodată, neprezentarea la timp a datelor statistice de către persoana cu funcție de răspundere va fi sancționată cu amendă de la 15 la 45 de UC (750-2250 lei) în loc de amenda de la 120 la 170 UC, care este acum în vigoare (6000-8500 lei). Amendă de la 250 la 350 UC (12500-17000 lei) aplicată persoanei juridice, va fi substituită cu amendă de la 45 la 55 UC (2250-2750 lei). Documentul mai prevede concretizarea organului care constată contravenţiile menționate supra, ținând cont de reorganizarea Biroului Național de Statistică. Astfel, de constatarea și examinarea acestora se va ocupa BNS şi centrele regionale pentru statistică. În drept să examineze cauzele contravenţionale şi să aplice sancţiuni vor fi directorul general al BNS, directorii generali adjuncţi, şefii şi adjuncţii centrelor regionale pentru statistică. Proiectul a fost votat prin asumarea răspunderii Guvernului în fața Parlamentului, în temeiul art. 1061 alin. 1 din Constituția RM, care prevede că Executivul își poate angaja răspunderea față de un program, o declarație de politică generală sau un proiect de lege, precum și în conformitate cu art. 119 din Regulamentul Parlamentului.
