Serviciile excursioniste vor fi scutite de TVA fără drept de deducere

Ministerul Economiei și Infrastructurii propune spre consultare publică proiectul hotărârii de Guvern cu privire la aprobarea proiectului de lege pentru modificarea unor acte normative, ce are ca scop facilitarea activității mediului de afaceri din domeniul turismului. Proiectul vizează Codul fiscal (CF), Legea nr.93/1998 cu privire la patenta de întreprinzător, Legea nr.352/2006 cu privire la organizarea şi desfăşurarea activității turistice în Republica Moldova, Legea nr. 231/2010 cu privire la comerțul interior și Codul contravențional. Astfel, se propune completarea art. 103 alin.5) din CF (scutirea de TVA) cu prevederea conform căreia serviciile excursioniste, de recreere și agrement din cadrul programelor și evenimentelor turistice (servicii de interpretare artistică și sportive, servicii prestate de parcuri tematice și parcuri de distracții) să fie scutite de TVA fără drept de deducere. În acest sens, se propune includerea în uz a noțiunii ”pachet de servicii excursioniste, ” aceasta fiind argumentată de faptul că, în Republica Moldova, o bună parte din activitatea turistică se bazează pe activitățile de organizare a excursiilor. Acestea sunt incluse în pachete care conțin transport și alimentație, însă durata acestora, de regulă, nu depășește 24 de ore și nici nu includ cazare de cel puțin o noapte. Respectiv, ele nu se încadrează în noțiunea clasică de pachet de servicii turistice. Proiectul poate fi consultat până la 23 iulie curent.
