Soluția fiscală individuală anticipată – un instrument nou prevăzut în proiectul politicii bugetar-fiscale pentru 2017

În legislația fiscală a Republicii Moldova poate fi implementat conceptul de Soluție fiscală individuală anticipată (SFIA). Este una din noutățile incluse în proiectul politicii bugetare, fiscale și vamale pe anul 2017, expus de Ministerul finanţelor pentru consultări publice. SFIA constituie un act emis de autoritățile fiscale în vederea soluționării unei cereri a persoanei fizice sau juridice, ce desfășoară activitate de întreprinzător, referitoare la reglementarea unor situații fiscale specifice. Măsura se înscrie printre instrumentele ce oferă posibilitatea persoanelor fizice și juridice, care desfășoară activitate antreprenorială de a gestiona riscul fiscal, la care se supun din cauza unor lacune în legislația fiscală, precum și unor prevederi normative, care generează interpretări duble. Totodată, precum specifică MF, SFIA va avea beneficii și pentru stat, reducînd situațiile de conflict ce apar între autorități și întreprinzători și va servi drept oportunitate de perfecționare a legislației fiscale. Prin emiterea unei SFIA organele fiscale vor preciza modul în care vor fi aplicate prevederile legislației fiscale pentru o anumită situație sau în cazul unor tranzacții specifice. Din momentul emiterii SFIA aceasta devine obligatorie pentru organele fiscale și alte organe cu atribuții de administrare fiscală, dar numai în cazul cînd termenii şi condițiile stabilite inițial sunt strict respectate de către persoanele fizice ți juridice, ce desfășoară activitate de întreprinzător, iar cadrul legal fiscal rămîne neschimbat. SFIA este aplicată cu succes în România, Polonia, Germania, Austria, Suedia și alte țări.
