Stabilirea și plata indemnizației în cazul decesului unuia dintre soți

Dreptul la indemnizaţie se acordă soțului supraviețuitor cu domiciliul în Republica Moldova în cazul decesului soțului care a beneficiat de pensie pentru limită de vârstă mai puțin de 5 ani după stabilirea dreptului la pensie. Totodată, este necesar ca soțul supraviețuitor să fi avut cel puțin 15 ani de căsătorie cu persoana decedată. În Monitorul Oficial a fost publicată Hotărârea Guvernului nr. 712 din 27.12.2019 pentru aprobarea Regulamentului cu privire la stabilirea și plata indemnizației în cazul decesului unuia dintre soți. Potrivit documentului, indemnizația poate fi solicitată de către soțul supraviețuitor în termen de 3 ani de la data decesului. Aceasta se acordă indiferent dacă soțul supraviețuitor este sau nu beneficiar de pensii în sistemul public de pensii. Cererea pentru stabilirea indemnizaţiei se depune personal de către soțul supraviețuitor la casa teritorială de asigurări sociale de la domiciliu. La cerere se anexează actul de identitate al solicitantului, certificatul de deces și certificatul de căsătorie. Indemnizaţia se stabileşte din luna depunerii cererii. Cuantumul indemnizaţiei se stabilește în mărimea pensiei pentru limită de vârstă aflată în plată la data decesului beneficiarului de pensie, dar nu poate depăși suma a cinci salarii medii lunare prognozate pe economie pentru anul în care a avut loc decesul. Plata indemnizației în cazul decesului unuia dintre soți stabilite, dar neîncasate pe o perioadă de 6 luni de către soțul supraviețuitor, se suspendă și se reia din luna în care beneficiarul a depus cererea şi actele ce îi atestă identitatea la Casa teritorială de asigurări sociale, aceasta fiind achitată retroactiv de la data suspendării. Indemnizația neplătită la timp din vina organului de asigurări sociale responsabil de stabilirea şi plata indemnizațiilor se plăteşte retroactiv, fără nicio limitare în termen. Sumele cu titlu de indemnizație plătite necuvenit din vina beneficiarului se rețin lunar în mărime ce nu depășesc 20% din cuantumul indemnizaţiei. În cazul decesului beneficiarului, indemnizațiile plătite necuvenit nu se urmăresc.
