Топлива duty-free не будет

Парламент Молдовы одобрил в первом чтении поправки, отменяющие законодательные положения о продаже нефтепродуктов в режиме беспошлинной торговли без уплаты НДС и акцизов в зоне таможенного контроля. Принятые депутатами поправки в Налоговый кодекс отменяют положения об освобождении от уплаты налогов импорта нефтепродуктов с их дальнейшей реализацией, которые предназначены для заправки при выезде из страны, в пределах вместимости резервуара транспортного средства. Эти положения позволяли открытие АЗС duty-free. Авторы поправок отметили, что нигде в мире не существует такой практики, это стимулирует уклонение от уплаты налогов и нелояльную конкуренцию. Они подчеркнули, что, хотя влияние АЗС duty-free на госбюджет и рынок нефтепродуктов еще не было точно оценено, реализация прежнего закона нанесла бы бюджету ущерб в миллиарды леев. Например, представители нефтяных компаний подсчитали, что без НДС и без акциза литр бензина будет стоить дешевле на 7 леев, а литр дизтоплива - почти на 5 леев. Таким образом, при продаже тысячи литров бензина без уплаты НДС и акцизных сборов потери госбюджета составят 7000 леев, а при продаже 1 млн литров - около 7 млн леев. Данные НАРЭ показывают, что в среднем на заправочной станции в Молдове продается за месяц более 1 тыс. тонн нефтепродуктов или почти 1,3 млн литров. При открытии всего десяти АЗС duty-free потери госбюджета могут составить почти 100 млн леев. Авторы поправок отметили, что положения о льготной торговле нефтепродуктами также нанесут ущерб и конкуренции в Молдове, особенно сельхозпроизводителям, которые используют нефтепродукты в технологических процессах, уплачивая налоги. Эти освобождения могут также мотивировать экономических субъектов и физических лиц осуществлять фиктивный или экономически необоснованный выезд из страны своих транспортных единиц с целью приобретения топлива, не облагаемого НДС и акцизами, с дальнейшим потреблением их на территории Молдовы. Кроме того, положения о льготной продаже нефтепродуктов были утверждены вопреки отрицательному заключению правительства, без которого Конституция запрещает парламенту принимать поправки, касающиеся увеличения или сокращения бюджетных доходов.
