Anularea ştampilei pe acte, aprobată în prima lectură

Ștampilele nu vor mai fi obligatorii în Republica Moldova. Un proiect de lege a fost susținut astăzi, 10 iunie, în prima lectură de către Parlament. În viziunea Ministerului Justiției, proiectul de Lege va avea un impact pozitiv asupra mediului de afaceri, în special pentru agenții economici mici, producători de volum mic. Un alt element benefic menționat de MJ ar fi reducerea timpului și a costurilor pentru înregistrarea unei afaceri. Totodată, această prevedere va spori și volumul de comerț. Unii deputați s-au arătat îngrijorați de inițiativa dată. Potrivit socialistului Bolea, în urma adoptări proiectului moldovenii ar putea utiliza această normă în scopuri mai puțin nobile, iar semnătura ar putea fi ușor contrafăcută. Totodată, acesta spune că Legea dată ar putea duce la un număr de litigii. Viceministrul justiției, Eduard Serbenco spune că aceste preocupări nu-şi au suport pentru că în contextul în care tehnologiile sunt atât de evoluate o ștampilă poate fi ușor contrafăcut. Ștampila nu este un element de identificare a persoanei juridice, elementul de identificare este semnătura. Despre temerile că o semnătură ar putea fi contrafăcută, Serbenco spune că acest lucru poate fi demonstrat prin expertizare. Totuși, reprezentantul justiției afirmă că este prezent un pericol, dar cultul juridic trebuie să evolueze. În contextul în care unele acte au alocat spațiu pentru aplicarea ştampilei, Serbenco spune că aplicarea ei nu este obligatorie, iar pe parcurs aceste vor fi refăcute. Mandatele, facturile, dar și alte documente vor fi aduse treptat în concordanță cu această măsură, eliminarea obligativității ștampilei. De menționat, utilizarea ștampilei va fi opțională. Proiectul nu prevede ca agenții economici vor fi obligați să renunțe la aceste lement de identificare. Proiectul a fost susținut în prima lectura că ulterior să fie adus în concordanță cu mai multe legi. Deputații au avertizat că în cazul în care legislația nu va fi armonizată cu acest proiect de Lege, sorți de izbândă în a doua lectură nu va avea.
