Cu privire la indicarea în partea dreaptă de sus a certificatelor de concediu medical a notelor “100%” și “prima zi”

Angajatul a adus un certificat de concediu medical și a spus angajatorului că este bolnav de cancer. Cu toate acestea, în certificatul medical nu există nici o informație referitoare la acest fapt. Cum să procedăm în situația în care este cunoscut faptul că persoanele bolnave de cancer trebuie să beneficieze de îndemnizația de concediu medical achitată în proporție de 100% din contul bugetului asigurărilor sociale de stat, indiferent de stagiu de muncă al angajatului? Conform art. 55 din HG nr. 469 din 24 mai 2005 pentru aprobarea Instrucțiunii privind modul de eliberare a certificatului de concediu medical, Certificatul medical se păstrează în instituţia medicală pe tot parcursul incapacităţii temporare de muncă a pacientului. În rubricile „diagnoza” şi „diagnoza finală” în toate cazurile se indică semnul „Z”. La solicitarea pacientului, după semnarea de către acesta a consimțămîntului informat, în caz de îmbolnăvire de tuberculoză, SIDA sau maladie oncologică, în partea dreaptă de sus a certificatului de concediu medical se înscrie „100%” şi „din prima zi”, iar pentru incapacitatea temporară de muncă a femeilor gravide se înscrie „din prima zi”, confirmat prin ştampilă. Evident că, în situația la care ne-am referit, în partea dreaptă de sus a certificatului medical nu sunt scrise notele „100%” și „ din prima zi”, din cauza faptului că pacientul nu a fost informat cu privire la acest lucru. În consecință, pentru ca în timpul controalelor să nu apară probleme, pacientul ar trebui să solicite medicului să indice aceste note, astfel încât să poată beneficia de indemnizaţiile pentru incapacitate temporară de muncă în cuantum de 100% din calculul de bază. Totodată, drept sursă de finanțare a beneficiilor acordate din prima zi să fie indicat bugetul de stat al asigurărilor sociale.
