Legea liberalizării capitalului și amnistia fiscală pot transforma Moldova într-o „zonă gri”

Legea liberalizării capitalului și stimulării fiscale nu poate fi una în favoarea publicului larg, iar stimularea fiscală poate submina disciplina fiscală într-o țară cu un segment foarte larg al „economiei gri”. Aceasta este opinia lui Ion Tăbârță și Veaceslav Berbeca, autorii studiului „Amnistia fiscală din 2007 și liberalizarea capitalului & stimularea fiscală din 2016: două acte din aceiași piesă”. Autorii spun că votarea legii ar putea anihila rezultatele investigației de elucidare a furtului bancar și recuperare a banilor efectuate de compania Kroll. Există suspiciuni rezonabile că banii din „miliardul furat” ar putea fi legalizați prin intermediul acestei legi. Acest proiect nu prevede mecanisme de control clare care ar putea asigura faptul că banii legalizați nu provin din „miliardul furat”. Totodată, Republica Moldova ar putea deveni o „zonă gri”, de legalizare a banilor iliciți prin invadarea de „bani murdari” de proveniență obscură. Nu este exclus, că proiectul de lege din 2016 să fie un reload al celebrului „Laundromat”. În concluzii, autorii publicației mai afirmă că legea amnistiei fiscale va împiedica recuperarea mijloacelor financiare la bugetele locale. Această inițiativă prevede anularea restanțelor, majorărilor și amenzilor inclusiv amânate și eșalonate (reeșalonate). În același timp, proiectul de lege va submina agenda de reforme în domeniul justiției, fiindcă prevede excepții de control din partea organelor de urmărire penală și a Autorității Naționale de Integritate al persoanelor care își vor legaliza averile dobândite în mod fraudulos.
