Работник принес листок о медицинском отпуске и сказал, что болен онкологическим заболеванием. Однако на самом листке о медицинском отпуске никаких отметок, свидетельствующих об этом, нет. Как быть в таком случае, если известно, что больным онкологическими заболеваниями больничные должны быть оплачены с первого дня за счет средств бюджета государственного социального страхования и в размере 100% основы расчета, независимо от страхового стажа больного? Пунктом 55 Инструкции о порядке выдачи листка о медицинском отпуске, утвержденной ПП № 469 от 24 мая 2005 г., опубликованной в МО № 77-79 от 03.06.2005 г., установлено, что листок о медицинском отпуске хранится в медицинском учреждении на протяжении всего периода временной нетрудоспособности пациента. В графах «диагноз» и «окончательный диагноз» во всех случаях отмечается знак „Z”. По запросу пациента, после подписания им информированного согласия, в случае заболевания туберкулезом, СПИДом или онкологическим заболеванием, в правом верхнем углу листка о медицинском отпуске делается отметка «100%» и «с первого дня», а в случаях временной нетрудоспособности беременных женщин – отметка «с первого дня», подтвержденные печатью. Очевидно, в данном случае в правом верхнем углу листка о медицинском отпуске указанные отметки отсутствуют в связи с тем, что пациент не был об этом проинформирован. Соответственно, чтобы во время проверки не возникло проблем, пациент должен запросить у врача сделать указанные отметки, для того чтобы он смог получить пособие по временной нетрудоспособности в размере 100% основы расчета, а также чтобы источником финансирования данного пособия с первого дня был бюджет государственного социального страхования.
