Schimb de informații fiscale cu autoritățile specializate de peste hotare

În conformitate cu prevederile Regulamentului privind punerea în aplicare a prevederilor Hotărârii Guvernului nr. 1275 din 26 decembrie 2018, aprobat prin Ordinul Serviciului Fiscal de Stat nr. 164 din 5 aprilie 2019, publicat în Monitorul Oficial al Republicii Moldova nr. 162-166 (7085 – 7089) din 10 mai 2019, au intrat în vigoare noi norme și proceduri ce țin de realizarea schimbului de informații cu administrațiile fiscale străine și asistență în vederea recuperării în Republica Moldova a unor creanțe fiscale stabilite într-un stat străin, precum și recuperarea într-un stat străin a creanțelor fiscale stabilite în Republica Moldova. Acestea vizează: • impozitul pe venitul persoanelor fizice şi juridice • contribuțiile de asigurări sociale de stat • impozitul pe bunurile imobiliare • taxa pe valoarea adăugată • accizele • taxele rutiere • taxele pentru resursele naturale • taxele locale. În acest context, Serviciul Fiscal de Stat este în drept să solicite de la administrațiile fiscale străine informații cu caracter fiscal despre contribuabilii din Republica Moldova și din străinătate, în funcție de necesitatea stabilită în cadrul controalelor fiscale. Schimbul de informații este reglementat de 50 de tratate bilaterale de evitare a dublei impuneri și de Convenția multilaterală a OCDE privind asistența administrativă reciprocă în materie fiscală (în vigoare pentru Republica Moldova din 1 martie 2012), ai cărei semnatari sunt la etapa actuală 128 state. Prin urmare, având ca bază îmbunătățirea continuă a administrării fiscale și racordarea la standardele europene, Serviciul Fiscal de Stat dispune de pârghii eficiente de recuperare a creanțelor fiscale cu element de extraneitate, dar și recepționare, la solicitare, a informațiilor cu caracter fiscal aferente persoanelor fizice și juridice.
