SFS: Intentarea procedurii de insolvabilitate nu afectează obligația debitorului de a prezenta dare de seamă fiscală

În conformitate cu prevederile al.2 din art.187 al Codului fiscal, cu excepția cazurilor expres prevăzute de legislația fiscală, contribuabilul este obligat să prezinte la unul dintre organele fiscale teritoriale dări de seamă privind impozitele și taxele. În asemenea circumstanțe, debitorul nu este eliberat de prezentarea dărilor de seamă. Intentarea procedurii de insolvabilitate nu afectează obligația debitorului de a prezenta darea de seamă fiscală și de a ține evidență contabilă. În ceea ce privește masa debitoare, aceste obligații sunt îndeplinite de administrator/lichidator, care răspunde, în limita informației de care dispune, pentru îndeplinirea obligațiilor, fapt reglementat de art.113 din Legea insolvabilității. Odată cu intentarea procedurii de insolvabilitate începe un nou exercițiu financiar. Primul exercițiu financiar este incomplet și durează până la sfârșitul anului fiscal. De asemenea, Legea insolvabilității, care stabilește expres impozitele, taxele și alte obligații de plată, majorări de întârziere (penalități), calculate din momentul intentării procesului de insolvabilitate sunt obligații de plată curente (art. 2 al Legii insolvabilității ). Ținând cont de cele menționate, administratorul procesului de insolvabilitate al debitorului este obligat să prezente dările de seamă fiscale în termenii și modul stabilit de legislația în vigoare.
