О налоговом учете физических лиц, осуществляющих лицензированную профессиональную деятельность

Главная государственная налоговая инспекция опубликовала в МО № 238-246 от 15 августа 2014 года Приказ Nr. 1169 от 01.08.2014 о налоговом учете физических лиц, осуществляющих лицензированную профессиональную деятельность. Приказ подготовлен в соответствии со ст. 161 ч. (1), ст. 163 ч. (2) и ст. 165 ч. (6) Налогового кодекса № 1163-XIII от 24 апреля 1997 года (повторно опубликован в Официальном мониторе Республики Молдова от 8 февраля 2007 года, специальный выпуск), а также в целях исполнения Постановления Конституционной Палаты № 13 от 22 мая 2014 года о декларировании неконституционности одной нормы Закона № 324 от 23 декабря 2013 года, a также исполнительного документа по делу № 3-166/14 от 3 апреля 2014 года, которым было приостановлено действие Приказа ГГНИ № 185 от 27 февраля 2014 года. В соответствии с Приказом, начиная с даты его официального опубликования – 15 августа, для физических лиц, осуществляющих лицензированную профессиональную деятельность, зарегистрированных в налоговом учете до 7 декабря 2012 года (дaтa ввода в действии Закона № 235 от 26 октября 2012 года (Официальный монитор Республики Молдова № 248-251 от 7 декабря 2012 года), которым были внесены изменения в ст. 163 ч. (2) Налогового кодекса), в целях налогового учета используется фискальный код, присвоенный и подтвержденный путем выдачи сертификата о присвоении фискального кода до указанной даты. Для физических лиц, осуществляющих лицензированную профессиональную деятельность, зарегистрированных в налоговом учете после 7 декабря 2012 года, в целях налогового учета используется фискальный код, указанный в лицензии для осуществления данной деятельности. Приказом также устанавливается, что с согласия лиц, указанных в п. 1 Приказа, в целях налогового учета может быть использован личный фискальный код обладателя лицензии, позволяющей осуществление профессиональной деятельности.
