1. (29.2.10.2) Cum urmează să fie înregistrată transmiterea în locațiune a proprietății imobiliare de către persoanele fizice care nu desfășoară activitate de întreprinzător, altor subiecți decât cei specificați la art.90 din Codul fiscal?

Contractul de locațiune este obiect al dreptului civil, fiind reglementat de art.875 din Codul civil, potrivit căruia o parte (locator) se obligă să dea celeilalte părţi (locatar) un bun determinat individual în folosinţă temporară sau în folosinţă şi posesiune temporară, iar aceasta se obligă să plătească chirie. Conform prevederilor art. 876 alin. (1) din codul nominalizat, contractul de locațiune trebuie să fie întocmit în formă scrisă. Totodată, în cazul lipsei unui asemenea contract, potrivit pct.6 din Ordinul nr.693 din 26 decembrie 2007, Serviciul Fiscal de Stat propune persoanei fizice-locator să depună o Declaraţie (cerere în formă liberă) prin care va specifica numele, prenumele, patronimicul, codul fiscal al persoanei fizice-locator precum şi numele, prenumele, patronimicul, codul fiscal al persoanei fizice-locatar, bunul dat în locaţiune (suprafaţa în m2), termenul locaţiunii și preţul locaţiunii. În cazul neînregistrării contractului de locaţiune, arendă, uzufruct al proprietăţii imobiliare şi neachitării impozitului din venitul obţinut, Serviciul Fiscal de Stat va estima venitul persoanei fizice care nu desfăşoară activitate de întreprinzător prin metode şi surse indirecte, în conformitate cu prevederile art.189 şi 225 din Codul fiscal. [modificările operate în Baza generalizată a practicii fiscale conform Legii nr.288 din 15.12.2017, în vigoare 01.01.2018 ])
