1. (4.9.49) Are entitatea dreptul la restituirea sumei accizei anterior achitate la importul mărfurilor accizate în cazul returului acestor mărfuri producătorului nerezident al Republcii Moldova?

Conform art.124 alin.(9) din Codul fiscal, suma accizelor achitată la introducerea pe teritoriul vamal al Republicii Moldova a mărfurilor străine supuse accizelor în regim vamal de import se restituie la scoaterea acestora de pe teritoriul vamal, la plasarea lor sub destinaţie vamală magazin duty-free, la plasarea lor sub destinaţie vamală zonă liberă, în modul stabilit de Guvern. În acest sens, pct.201 din Regulamentul privind restituirea accizelor aprobat prin Hotărîrea Guvernului nr.1123 din 28 septembrie 2006, prevede că agenţilor economici, indiferent de faptul dacă sunt sau nu înregistraţi ca subiecţi ai impunerii cu accize, li se efectuează restituirea sumelor accizelor achitate la introducerea pe teritoriul vamal al Republicii Moldova a mărfurilor străine supuse accizelor în regim vamal de import în cazul scoaterii acestor mărfuri de pe teritoriul vamal, plasarea lor sub destinaţia vamală magazin duty-free, plasarea lor sub destinaţia vamală zonă liberă. Documentele confirmative pentru a beneficia de restituirea accizelor, sunt stabilite la pct.202 al Regulamentului menționat. Astfel, în condițiile acțiunii art. 124 alin.(9) din Codul fiscal, în cazul returului mărfurilor accizate producătorului nerezident al Republcii Moldova, entitatea va beneficia de restituirea sumei accizei anterior achitate, în limita cantităţii acestor mărfuri scoase de pe teritoriul vamal al Republicii Moldova, la prezentarea documentelor justificative stabilite la pct.202 din Regulament.
