11. (29.1.4.7) Poate contribuabilul beneficia de scutirea pentru persoanele întreţinute dacă acestea își fac studiile în țară sau peste hotarele Republicii Moldova?

Dreptul și mărimea scutirii pentru persoanele întreținute acordate persoanei fizice la calcularea impozitului pe venit sunt stabilite în art. 35 alin. (1) din Codul fiscal. Potrivit alin. (2) al aceluiași articol, persoană întreținută se consideră persoana care întrunește toate cerințele de mai jos:
  1. este un ascendent sau descendent al contribuabilului sau al soţiei (soţului) contribuabilului (părinţii sau copiii, inclusiv înfietorii şi înfiaţii) ori persoană cu dezabilități în urma unei afecţiuni congenitale sau din copilărie rudă de gradul doi în linie colaterală;
  2. are un venit ce nu depășește suma anuală în mărimea stabilită la acest articol.
Totodată, potrivit pct. 34 din Regulamentul cu privire la reţinerea impozitului pe venit din salariu şi din alte plăţi efectuate de către patron în folosul angajatului, precum şi din plăţile achitate în folosul persoanelor fizice care nu practică activitate de întreprinzător pentru serviciile prestate şi/sau efectuarea de lucrări, aprobat prin Hotărîrea Guvernului nr.697 din 22 august 2014, documentele care confirmă dreptul la scutirea pentru persoana întreţinută sunt: - documentele indicate în pct.30 din Regulamentul menționat, care atestă că contribuabilul este rezident al Republicii Moldova; - copia certificatului de naştere (înfiere) al persoanei întreţinute (în cazul în care persoana întreţinută este un descendent) sau copia certificatului de naştere (înfiere) al contribuabilului (în cazul în care persoana întreţinută este un ascendent al contribuabilului); - copia buletinului de identitate al persoanei întreţinute; - copia certificatului de căsătorie al contribuabilului (în cazul în care acesta are un alt nume de familie decît cel indicat în certificatul de naştere); - copia documentului care confirmă mărimea bursei (în cazul în care persoana întreţinută este student și învaţă peste hotarele Republicii Moldova). Astfel, ținînd cont de prevederile menționate, în cazul în care persoana întreținută întrunește toate cerințele menționate, contribuabilul va fi în drept să beneficieze de scutirea pentru persoana întreţinută, care își face studiile în tară sau peste hotare. [modificările operate în Baza generalizată a practicii fiscale conform Legii nr.201 din 28.07.2016, în vigoare 09.09.2016 ]
