11. (31.6.3) La încetarea activității independente se va efectua un control fiscal pentru perioada activității desfășurate?

Contribuabilul care a încetat activitatea, conform prevederilor art. 697 alin. (3) și (4) din Codul fiscal, este obligat în termen de 5 zile de la adoptarea unei astfel de decizii să prezinte o informație la subdiviziunea Serviciului Fiscal de Stat, cu anexarea obligatorie a declarației cu privire la impozitul pe venit din activitatea independentă. La cererea de încetare a activității independente și de încetare /radiere din evidență a MCC se vor anexa și setul de documente aferente anexelor nr. 1-2 aprobate prin Ordinul Ministerului Finanțelor nr. 2 din 9 ianuarie 2017 și documentele contabile pentru efectuarea controlului fiscal. Subdiviziunile SFS (DDF) efectuează controlul fiscal la încetarea activității independente pe principii generale în temeiul Deciziei privind inițierea controlului fiscal. La finalizarea controlului fiscal se va întocmi actul de control potrivit art. 216 alin. (5) din Codul fiscal, indiferent de faptul dacă au fost sau nu depistate încălcări ale legislației. În cadrul controlului se vor verifica obligațiile contribuabilului privind ținerea contabilității în partidă simplă aferente procurării/achiziționării bunurilor, ținerea corectă a înscrierilor în contabilitate a veniturilor și cheltuielilor, corespunderea înregistrărilor în ordine cronologică în baza documentelor justificative ce țin doar de activitatea independentă. După efectuarea controlului, persoana fizică va primi un exemplar al actului de control și Decizia pe marginea acestuia cu restituirea documentelor contabile. Pentru încălcarea legislației persoana fizică care desfășoară activitate independentă va fi trasă la răspundere conform prevederilor Codului fiscal și Codului contravențional.
