5. (28.4.8) Poate fi considerat actul de îndeplinire a lucrărilor drept un document confirmativ a serviciului exportat?

Potrivit prevederilor art. 102 alin. (15) din Codul fiscal şi pct. 32 alin. 2) lit. a) din Regulamentul privind restituirea taxei pe valoarea adăugată, aprobat prin Hotărîrea Guvernului Republicii Moldova nr. 93 din 01.02.2013, pentru livrările de servicii, subiecții impozabili, împreună cu alte documente, urmează să depună confirmarea de la beneficiarul serviciilor exportate (în caz de necesitate, se prezintă traducerea perfectată de traducător autorizat conform legislației). Conform art. 20 alin.(4) din Legea contabilităţii nr. 113 din 27.04.2007 pentru operaţiunile de export-import al activelor şi serviciilor, drept documente primare pot fi utilizate documentele aplicate în practica internaţională sau cele prevăzute de contract. Astfel, luînd în consideraţie faptul că actul de îndeplinire a lucrărilor ca conţinut este un act consimţit de ambele părţi ce confirmă prestarea serviciilor de către prestator şi recunoașterea lor de către beneficiar, acesta poate reprezinta o formă de confirmare a serviciului prestat la export.
