5. (30.3.16) Care este baza impozabilă a mărfurilor care, în procesul utilizării, cauzează poluarea mediului?

Potrivit art.11 alin.(5) din Legea nr.1540 din 25 februarie 1998 privind plata pentru poluarea mediului, baza impozabilă a mărfurilor care, în procesul utilizării, cauzează poluarea mediului se stabileşte, după cum urmează:
  1. pentru mărfurile indicate în anexa nr.8 din Legea menționată:
    1. pentru mărfurile importate – valoarea facturată a acestora (valoarea din invoice); pentru mărfurile procurate de la persoane fizice şi juridice de pe teritoriul Republicii Moldova care nu au relaţii fiscale cu sistemul bugetar al acestora –valoarea de procurare a mărfurilor respective;
    2. pentru mărfurile de fabricaţie proprie – valoarea livrării mărfurilor respective, fără T.V.A
    .;
  3. pentru ambalajul primar compozit (clasificat la poziția tarifară 4819 20 000), precum şi pentru ambalajul primar (clasificat la poziţiile tarifare 3923 21 000, 3923 29, 3923 30 şi 7612) care conţine produse – cantitatea (numărul) unităţilor de ambalaje de fiecare categorie de volum unităţii de ambalaj în care este ambalat produsul, conform alin.(4) pct.2)–4).
În lipsa indicării volumului produsului, baza impozabilă reprezintă cantitatea (numărul) unităţilor de ambalaje de fiecare categorie a greutăţii produsului ambalat conform alin.(4) pct.2)–4). [Completare în Baza generalizată a practicii fiscale în temeiul Legii nr.313 din 22.12.2017 pentru modificarea şi completarea Legii nr.1540/1998 privind plata pentru poluarea mediului, în vigoare de la data 30.12.2017].
