În conformitate cu prevederile art. 4 alin. (4) al Legii nr. 93-XIV din 15.07.1998 cu privire la patenta de întreprinzător, în cazul în care, conform legislaţiei, pentru desfăşurarea în baza patentei a unor genuri de activitate, specificate în Anexa la această Lege, este necesară autorizaţia autorităţii administraţiei publice locale, la cererea de eliberare a patentei sau de prelungire a termenului ei de valabilitate se anexează decizia autorităţii respective. În legătură cu acest fapt, la organul care eliberează patenta (inspectoratul fiscal teritorial sau primărie) trebuie să rămînă originalul autorizaţiei sau copia acesteia? În conformitate cu prevederile art. 14 al Legii nr. 231 din 23.09.2010 (în continuare – Lege), autorizaţia pentru desfăşurarea activităţii de comerţ se eliberează de către autoritatea administraţiei publice locale de nivelul întîi sau a municipiului Chişinău, în a cărei raze teritoriale urmează să-şi desfăşoare activitatea comerciantul. Autorizaţia de funcţionare se eliberează în baza cererii depuse la autoritatea administraţiei publice locale, pentru fiecare unitate comercială separat. În acelaşi timp, conform prevederilor art. 22 al Legii, autorităţile administraţiei publice locale (lucrătorii structurilor economice ale consiliilor municipale şi raionale) controlează conformitatea unităţilor de comerţ cu condiţiile prescrise în autorizaţiile eliberate, respectarea regulilor de comercializare a produselor şi serviciilor în limita competenţei lor. Respectiv, în scop de regularizare a activităţii respective indicate în patenta de întreprinzător, la organul care eliberează patenta rămîne copia autorizaţiei, eliberate de către autoritatea administraţiei publice locale, iar la locul desfăşurării activităţii – originalul autorizaţiei.
