Codul nomenclator în factura fiscală

Codul nomenclator al mărfii este obligatoriu de indicat in factura fiscală? Cum eliberăm marfa care am primit-o fără cod nomenclator? În conformitate cu prevederile art. 117 alin. (2) din Codul fiscal, factura fiscală trebuie să includă următoarele informații: 1) numărul curent al facturii; 2) denumirea (numele), adresa și codul fiscal al furnizorului; 3) data eliberării facturii; 4) data livrării, dacă ea nu corespunde cu data eliberării facturii; 5) denumirea (numele), adresa și codul fiscal al cumpărătorului; 6) tipul livrării; 7) pentru fiecare tip de livrare de mărfuri, servicii: a) cantitatea mărfii; b) prețul de achiziție/livrare și mărimea adaosului comercial cumulativ – în cazul livrării mărfurilor social importante; - prețul unui articol de marfă fără TVA; - cota TVA; - suma TVA pe un articol de marfă; - suma totală a livrării de mărfuri, servicii, care urmează a fi achitată; - suma totală a TVA. Totodată, modalitatea de reflectare a indicatorilor în factura fiscală este stabilită prin Instrucțiunea cu privire la aprobarea și completarea formularului tipizat de document primar cu regim special “Factură fiscală“, aprobat prin ordinul Ministerului Finanțelor nr.115 din 6 septembrie 2010. Astfel, conform normelor stabilite prin această instrucțiune, în coloana 10.1 se indică corespunzător pentru fiecare tip de marfă denumirea mărfurilor livrate. În cazul livrării mărfurilor impozabile cu accize și a celor impozitate cu TVA la cota redusă, se indică și datele privind codul nomenclator conform Nomenclatorului Mărfurilor al Republicii Moldova aprobat prin Legea nr.172 din 25.07.2014. In acest context, numai în cazul livrării mărfurilor impozabile cu accize și a celor impozitate cu TVA la cota redusă, la perfectarea facturii fiscale este obligatorie ca în coloana 10.1 să se indice și datele privind codul nomenclator al mărfii.
